The success of a capitalist economy rests upon the ability of finance to sustain potentially infinite growth, based on funding today the output of tomorrow. Finance, however, needs rules. The aim of the law and finance scholarship is precisely to identify the best regulation of finance to support economic growth. Traditionally, law and finance is concerned with investor protection. This would be sufficient if the future were predictable. However, because the future is uncertain, the prices of financial assets are flawed (...) and in the short run they may result in serious mistakes, if not widespread crises. Although these mistakes are corrected in the long run, significant harm may occur in the meantime. Financial law should therefore be concerned not only with investor protection, but also with mitigating the temporary excesses of markets in allowing or restricting access to finance. The challenge of this goal is to remedy market myopia without allowing policymakers to abuse the power of governments. However imperfect, prices remain the best instrument of discipline and growth in a market economy. (shrink)

In this paper we defend structural representations, more specifically neural structural representation. We are not alone in this, many are currently engaged in this endeavor. The direction we take, however, diverges from the main road, a road paved by the mathematical theory of measure that, in the 1970s, established homomorphism as the way to map empirical domains of things in the world to the codomain of numbers. By adopting the mind as codomain, this mapping became a boon for all those (...) convinced that a representation system should bear similarities with what was being represented, but struggled to find a precise account of what such similarities mean. The euforia was brief, however, and soon homomorphism revealed itself to be affected by serious weaknesses, the primary one being that it included systems embarrassingly alien to representations. We find that the defense attempts that have followed, adopt strategies that share a common format: valid structural representations come as “homomorphism plus X”, with various “X”, provided in descriptive format only. Our alternative direction stems from the observation of the overlooked departure from homomorphism as used in the theory of measure and its later use in mental representations. In the former case, the codomain or the realm of numbers, is the most suited for developing theorems detailing the existence and uniqueness of homomorphism for a wide range of empirical domains. In the latter case, the codomain is the realm of the mind, possibly more vague and more ill-defined than the empirical domain itself. The time is ripe for articulating the mapping between represented domains and the mind in formal terms, by exploiting what is currently known about coding mechanisms in the brain. We provide a sketch of a possible development in this direction, one that adopts the theory of neural population coding as codomain. We will show that our framework is not only not in disagreement with the “plus X” proposals, but can lead to natural derivation of several of the “X”. (shrink)

In recent years, a number of different disciplines have begun to investigate the fundamental role context appears to play in a number of cognitive phenomena. Traditionally, linguistics, and the fields of communication and pragmatics in particular, have been the areas that have focused the most on contextual effects. Context has increasingly been studied for its role in influencing mental concepts, for some scholars being considered constitutive for most – if not all – concepts. Cognitive neuroscience is now starting to consider (...) in a systematic way how context interacts with neural responses, although this research is still scattered and concentrated in a small number of specific cases only. In this chapter, we attempt to tie these three levels together, since only from their integration can a comprehensive explanation of how context affects cognition be constructed. The way context drives language comprehension depends on the effects of context on the conceptual scaffolding of the listener, which in turn, is the result of his neural responses in combination to context. These neural responses derive from learning throughout the history of experiences of the individual, and the association between possible contexts and heard utterances. The road we take to accomplishing the multi-level integration between what appear to be distant domains, is a computational one. This approach meets with the mechanistic framework of explanation, which is currently held as the most appropriate way of approaching cognitive phenomena that is often characterized by a multiplicity of levels, as is the case with context. The core underlying concept of the neurocomputational framework here proposed, is an account of neural representation, based on structural similarity. Structural representations are still the best option on the market in cognitive science, but in their traditional form, derived from classical measurement theory, are affected by a number of serious drawbacks, including not being able to account for context. We suggest a different account of structural similarity, one informed by current neuroscience, where the homomorphic relations required for structural similarity are derived from neural population coding. In a preliminary mathematical sketch, we indicate how this approach can construct neural aggegations that are sensitive to context. (shrink)

Existe uma tensão entre Teoria e História: “[...] a poesia é mais filosófica e de caráter mais elevado que a história, porque a poesia permanece no universal e a história estuda apenas o particular” (Aristóteles, 2007, 43). Esta afirmação de Aristóteles talvez tenha sido a primeira indicação da referida tensão entre as duas formas de conhecimento: a histórica e a teórica. Na citação acima, a filosofia é a referência de um pensamento hierarquicamente superior, sendo que sua legitimação enquanto tal passa (...) pela universalidade de suas verdades. É importante salientar que a poesia nesta reflexão aristotélica é uma forma de conhecimento, embora difira da história no que concerne à matéria do conhecido: na primeira, o fato poderia ter acontecido; na segunda, aconteceu. Porque aconteceu, o fato é singular, e que poderia ter acontecido cai no âmbito do universal. Neste sentido, a chave para a compreensão da tensão entre história e teoria é a universalidade ou singularidade do conhecimento adquirido: “[...] é evidente que não compete ao poeta narrar exatamente o que aconteceu; mas sim o que poderia ter acontecido, o possível, segundo a verossimilhança ou a necessidade. O historiador e o poeta não se distinguem um do outro, pelo fato de o primeiro escrever em prosa e o segundo em verso [...]. Diferem entre si porque um escreveu o que aconteceu e o outro o que poderia ter acontecido” (Aristóteles, 2007, 43). Ao situar a história em nível menos elevado que a poesia, Aristóteles parece ter suscitado em pensadores contemporâneos a ideia da distinção entre conhecimento histórico e conhecimento teórico. O presente estudo versa sobre a natureza do conhecimento histórico e seus impasses metodológicos no uso dos referenciais teóricos necessários às suas indagações fundamentais. (shrink)

Digital Earth applications provide a common ground for visualizing, simulating, and modeling real-world situations. The potential of Digital Earth applications has increased significantly with the evolution of artificial intelligence systems and the capacity to collect and process complex amounts of geospatial data. Yet, the widespread techno-optimism at the root of Digital Earth must now confront concerns over high-risk artificial intelligence systems and power asymmetries of a datafied society. In this commentary, we claim that not only can current debates about data (...) governance and ethical artificial intelligence inform development in the field of Digital Earth, but that the specificities of geospatial data, together with the expectations surrounding Digital Earth applications, offer a fruitful lens through which to examine current debates on data governance and artificial intelligence ethics. In particular, we argue that for the implementation of ethical artificial intelligence and inclusive approaches to data governance, Digital Earth initiatives need to involve stakeholders and communities at the local level and be sensitive to social, legal, cultural, and institutional contexts, including conflicts that might arise within those contexts. The logical hexagon (or hexagon of opposition) is a strange, yet beautiful, highly symmetrical mathematical figure, mysteriously intertwining fundamental logical and geometrical features. It was discovered more or less at the same time (i.e. around 1950), independently, by a few scholars. It is the successor of an equally strange (but mathematically less impressive) structure, the “logical square” (or “square of opposition”), of which it is a much more general and powerful “relative”. The discovery of the former did not raise interest, (...) neither among logicians, nor among philosophers of logic, whereas the latter played a very important theoretical role (both for logic and philosophy) for nearly two thousand years, before falling in disgrace in the first half of the twentieth century: it was, so to say, “sentenced to death” by the so-called analytical philosophers and logicians. Contrary to this, since 2004 a new, unexpected promising branch of mathematics (dealing with “oppositions”) has appeared, “oppositional geometry” (also called “n-opposition theory”, “NOT”), inside which the logical hexagon (as well as its predecessor, the logical square) is only one term of an infinite series of “logical bi-simplexes of dimension m”, itself just one term of the more general infinite series (of series) of the “logical poly-simplexes of dimension m”. In this paper we recall the main historical and the main theoretical elements of these neglected recent discoveries. After proposing some new results, among which the notion of “hybrid logical hexagon”, we show which strong reasons, inside oppositional geometry, make understand that the logical hexagon is in fact a very important and profound mathematical structure, destined to many future fruitful developments and probably bearer of a major epistemological paradigm change. In 1995 Slater argued both against Priest’s paraconsistent system LP (1979) and against paraconsistency in general, invoking the fundamental opposition relations ruling the classical logical square. Around 2002 Béziau constructed a double defence of paraconsistency (logical and philosophical), relying, in its philosophical part, on Sesmat’s (1951) and Blanche’s (1953) “logical hexagon”, a geometrical, conservative extension of the logical square, and proposing a new (tridimensional) “solid of opposition”, meant to shed new light on the point raised by Slater. By using n-opposition (...) theory (NOT) we analyse Beziau’s anti-Slater move and show both its right intuitions and its technical limits. Moreover, we suggest that Slater’s criticism is much akin to a well-known one by Suszko (1975) against the conceivability of many-valued logics. This last criticism has been addressed by Malinowski (1990) and Shramko and Wansing (2005), who developed a family of tenable logical counter-examples to it: trans-Suszkian systems are radically many-valued. This family of new logics has some strange logical features, essentially: each system has more than one consequence operator. We show that a new, deeper part of the aforementioned geometry of logical oppositions (NOT), the “logical poly-simplexes of dimension m”, generates new logical-geometrical structures, essentially many-valued, which could be a very natural (and intuitive) geometrical counterpart to the “strange”, new, non-Suszkian logics of Malinowski, Shramko and Wansing. By a similar move, the geometry of opposition therefore sheds light both on the foundations of paraconsistent logics and on those of many-valued logics. (shrink)

Whereas geometrical oppositions (logical squares and hexagons) have been so far investigated in many fields of modal logic (both abstract and applied), the oppositional geometrical side of “deontic logic” (the logic of “obligatory”, “forbidden”, “permitted”, . . .) has rather been neglected. Besides the classical “deontic square” (the deontic counterpart of Aristotle’s “logical square”), some interesting attempts have nevertheless been made to deepen the geometrical investigation of the deontic oppositions: Kalinowski (La logique des normes, PUF, Paris, 1972) has proposed a (...) “deontic hexagon” as being the geometrical representation of standard deontic logic, whereas Joerden (jointly with Hruschka, in Archiv für Rechtsund Sozialphilosophie 73:1, 1987), McNamara (Mind 105:419, 1996) and Wessels (Die gute Samariterin. Zur Struktur der Supererogation, Walter de Gruyter, Berlin, 2002) have proposed some new “deontic polygons” for dealing with conservative extensions of standard deontic logic internalising the concept of “supererogation”. Since 2004 a new formal science of the geometrical oppositions inside logic has appeared, that is “ n -opposition theory”, or “NOT”, which relies on the notion of “logical bi-simplex of dimension m ” ( m = n − 1). This theory has received a complete mathematical foundation in 2008, and since then several extensions. In this paper, by using it, we show that in standard deontic logic there are in fact many more oppositional deontic figures than Kalinowski’s unique “hexagon of norms” (more ones, and more complex ones, geometrically speaking: “deontic squares”, “deontic hexagons”, “deontic cubes”, . . ., “deontic tetraicosahedra”, . . .): the real geometry of the oppositions between deontic modalities is composed by the aforementioned structures (squares, hexagons, cubes, . . ., tetraicosahedra and hyper-tetraicosahedra), whose complete mathematical closure happens in fact to be a “deontic 5-dimensional hyper-tetraicosahedron” (an oppositional very regular solid). In this paper, we introduce the concept of N-dimensional generalized Minkowski space, i.e., a space endowed with a metric tensor, whose coefficients do depend on a set of non-metrical coordinates. This is the first of a series of papers devoted to the investigation of the Killing symmetries of generalized Minkowski spaces. In particular, we discuss here the infinitesimal-algebraic structure of the space-time rotations in such spaces. It is shown that the maximal Killing group of these spaces is the direct product (...) of a generalized Lorentz group and a generalized translation group. We derive the explicit form of the generators of the generalized Lorentz group in the self-representation and their related, generalized Lorentz algebra. Focal brain metabolic effects detected by proton magnetic resonance spectroscopy (MRS) in obsessive-compulsive disorder (OCD) represent prospective indices of clinical status and guides to treatment design. Sampling bilateral pregenual anterior cingulate cortex (pACC), anterior middle cingulate cortex (aMCC), and thalamus in 40 adult patients and 16 healthy controls, we examined relationships of the neurometabolites glutamate+glutamine (Glx), creatine+phosphocreatine (Cr), and choline-compounds (Cho) with OCD diagnosis and multiple symptom types. The latter included OC core symptoms (Yale-Brown Obsessive-Compulsive Scale - YBOCS), depressive symptoms (...) (Montgomery-Åsberg Depression Rating Scale - MADRS), and general functioning (Global Assessment Scale - GAS). pACC Glx was 9.7% higher in patients than controls. Within patients, Cr and Cho correlated negatively with YBOCS and MADRS, while Cr correlated positively with the GAS. In aMCC, Cr and Cho correlated negatively with MADRS, while Cr in thalamus correlated positively with GAS. These findings present moderate support for glutamatergic and cingulocentric perspectives on OCD. Based on our prior metabolic model of OCD, we offer one possible interpretation of these group and correlational effects as consequences of a corticothalamic state of elevated glutamatergic receptor activity alongside below-normal glutamatergic transporter activity. : Autonomous driving systems promise important changes for future of transport, primarily through the reduction of road accidents. However, ethical concerns, in particular, two central issues, will be key to their successful development. First, situations of risk that involve inevitable harm to passengers and/or bystanders, in which some individuals must be sacrificed for the benefit of others. Secondly, and identification responsible parties and liabilities in the event of an accident. Our work addresses the first of these ethical problems. We are (...) interested in investigating how humans respond to critical situations and what reactions they consider to be morally right or at least preferable to others. Our experimental approach relies on the trolley dilemma and knowledge gained from previous research on this. More specifically, our main purpose was to test the difference between what human drivers actually decide to do in an emergency situations whilst driving a realistic simulator and the moral choices they make when they pause to consider what they would do in the same situation and to better understand why these choices may differs. "My work has had nothing to do with gay liberation," Michel Foucault reportedly told an admirer in 1975. And indeed there is scarcely more than a passing mention of homosexuality in Foucault's scholarly writings. So why has Foucault, who died of AIDS in 1984, become a powerful source of both personal and political inspiration to an entire generation of gay activists? And why have his political philosophy and his personal life recently come under such withering, normalizing scrutiny by commentators as (...) diverse as Camille Paglia, Richard Mohr, Bruce Bawer, Roger Kimball, and biographer James Miller? David M. Halperin's Saint Foucault is an uncompromising and impassioned defense of the late French philosopher and historian as a galvanizing thinker whose career as a theorist and activist will continue to serve as a model for other gay intellectuals, activists, and scholars. A close reading of both Foucault and the increasing attacks on his life and work, it explains why straight liberals so often find in Foucault only counsels of despair on the subject of politics, whereas gay activists look to him not only for intellectual inspiration but also for a compelling example of political resistance. Halperin rescues Foucault from the endless nature-versus-nurture debate over the origins of homosexuality and argues that Foucault's decision to treat sexuality not as a biological or psychological drive but as an effect of discourse, as the product of modern systems of knowledge and power represents a crucial political breakthrough for lesbians and gay men. Halperin explains how Foucault's radical vision of homosexuality as a strategic opportunity for self-transformation anticipated the new anti-assimilationist, anti-essentialist brand of sexual identity politics practiced by contemporary direct-action groups such as ACT UP. Halperin also offers the first synthetic account of Foucault's thinking about gay sex and the future of the lesbian and gay movement, as well as an up-to-the-minute summary of the most recent work in queer theory. "Where there is power, there is resistance," Michel Foucault wrote in The History of Sexuality, Volume I. Erudite, biting, and surprisingly moving, Saint Foucault represents Halperin's own resistance to what he views as the blatant and systematic misrepresentation of a crucial intellectual figure, a misrepresentation he sees as dramatic evidence of the continuing personal, professional, and scholarly vulnerability of all gay activists and intellectuals in the age of AIDS. In his philosophy, William of Ockham (1285-1347) offered an important and detailed response to the classical argument from the truth of a statement regarding the future to the necessity (unpreventability) of the statement. In this paper, Ockham’s solution and the possible formalisation of it are discussed in terms of modern tense and modal logic. In particular, the famous branching time formalisation suggested by A.N. Prior (1914-19) is discussed. Weaknesses and problems with this suggestion are pointed out, and an alternative formalisation (...) of Ockham’s solution without the use of branching time is presented. In 2005 St Andrews Studies published a volume of essays by Anscombe entitled Human Life, Action and Ethics, followed in 2008 by a second with the title Faith in a Hard Ground. Both books were highly praised. This third volume brings essays on the thought of historical philosophers in which Anscombe engages directly with their ideas and arguments. Many are published here for the first time and the collection provides further testimony to Anscombe's insight and intellectual imagination.

Jacob (history, New School for Social Research) proposes that the science of the 17th and 18th centuries was eventually accepted because it was made compatible with larger political and economic interests. A celebration of the recently concluded 33 volume edition of the Collected works of John Stuart Mill, produced over a period of nearly 30 years, the last 20 under the guiding genius (and hand) of general editor Robson. Following a tributary history of the project itself, essays cover Mill's career (...) as a thinker and as a bureaucrat and public servant, exploring the effects of the various milieu--domestic, political, administrative, religious, and cultural--in which he moved. MR. R. G. M. Nisbet has made the attractive suggestion that the Vinnius to whom Horace addressed his thirteenth epistle was the Vinnius Valens mentioned by the elder Pliny as a centurion of immense strength who had served in the praetorian guard of Augustus. To the points which he has made in support of this identification may be added the appropriateness, if Horace's Vinnius was a soldier, of the words victor propositi and the fact that Horace's comparison between Vinnius and (...) a pack-animal gains in point if Vinnius was famous for feats of strength involving wagons and beasts of burden. According to the ‘fact-plus-value’ model of pathology propounded by K. W. M. Fulford, ‘disease’ is a value term that ought to reflect a ‘balance of values’ stemming from patients and doctors and other ‘stakeholders’ in medical nosology. In the present article I take issue with his linguistic-analytical arguments for why pathological status must be relative to such a kind of medico-ethical normativity. Fulford is right to point out that Boorse and other naturalists are compelled to utilize evaluative terminology when they (...) characterize the nature of diseases and biological dysfunctions. But the relevant ‘biofunctional judgements’ are no less factual and empirical for that. While it is indeed evaluative to say that biological dysfunctions involve failures to execute naturally selected functions, such judgments are not bound to entail anything about what is good or bad for us, and what should be treated or not. In the last part of the paper I ruminate briefly on the relationship between ‘biological evaluationism’, on my construal, and descriptions of ‘causal biology’. As I note in my conclusion, a strict bioevaluative concept of disease can be valid for every species on earth, and thus be of particular usefulness in general biological contexts. (shrink)
